2.4.1. Official newspaper.
Official Newspaper. The official newspaper of the City of Bel Aire, Kansas in which official publications of the City of Bel Aire, Kansas shall be published shall be the Ark Valley News.
Alternative Designation. If at any time the Ark Valley News is unable to provide the services associated with serving as the official newspaper for the City of Bel Aire, the Wichita Eagle shall serve as the official newspaper of the City.

2.4.2. Ordinances.
The governing body shall have the care, management and control of the city and its finances, and shall pass all ordinances needed for the welfare of the city. All ordinances shall be valid when a majority of all the members-elect of the city council shall vote in favor. Where the number of favorable votes is one less than required, the mayor shall have power to cast the deciding vote in favor of the ordinance.
No ordinance shall contain more than one subject, which shall be clearly expressed in its title; and no section or sections of an ordinance shall be amended unless the amending ordinance contains the entire section or sections as amended and the section or sections amended shall be repealed.

2.4.3. Same; publication.
No ordinance, except those appropriating money, shall be in force until published in the official city newspaper by the city clerk. One publication of any such ordinance shall be sufficient unless additional publications are required by statute or ordinance. The publisher of the newspaper shall prefix such published ordinance by a line in parentheses stating the month, day and year of such publication.
In lieu of full publication of an ordinance pursuant to this section, a city may opt to publish a summary of the ordinance so long as:
The publication is identified as a “summary” and contains notice that the complete text of the ordinance may be obtained or viewed free of charge at the office of the city clerk;
the city attorney certifies the summary of the ordinance prior to publication to ensure that the summary is legally accurate and sufficient; and
the publication contains the city's official website address where a reproduction of the original ordinance is available for a minimum of one week following the summary publication in the newspaper. If an ordinance is subject to petition pursuant to state law, then the summary shall contain a statement that the ordinance is subject to petition.

2.4.4. Same; ordinance book.
Following final passage and approval of each ordinance, the city clerk shall enter the same in the ordinance book of the city as provided by law. Each ordinance shall have appended thereto the manner in which the ordinance was passed, the date of passage, the page of the journal containing the record of the final vote on its passage, the name of the newspaper in which published and the date of publication.

2.4.5. Resolutions, motions.
Except where a state statute or city ordinance specifically requires otherwise, all resolutions and motions shall be passed if voted upon favorably by a majority of a quorum of the city council.

2.4.6. Disposal of lost or abandoned property.
The Police Department of the City of Bel Aire, Kansas may sell or otherwise dispose of all lost or abandoned personal property recovered by the Police Department in the ordinary course of business of said department, excluding any property connected with any criminal case pending in the Bel Aire Municipal Court or another court with proper jurisdiction, after holding the same for at least 120 days and after publication as prescribed herein.

2.4.7. Claim of lost or abandoned property.
If a person delivers any lost or abandoned personal property to the Police Department for the purpose returning the same to its legal owner and the legal owner fails to claim said property, said person may claim said property after the Police Department has held said property for at least 120 days and after publication as prescribed herein, but prior to sale.

2.4.8. Notice of lost or abandoned property.
Publication in the Official Newspaper of the City of Bel Aire, Kansas of the sale of lost or abandoned property shall be made at least two (2) weeks prior to the date of the sale of the property, and shall describe the items to be sold and the date, time and location of the sale. All proceeds from the sale of lost or abandoned property shall be deposited in the General Fund of the City of Bel Aire, Kansas.

2.4.9. City incorporated and declared a city of the second class.
The City of Bel Aire was a duly incorporated City of the Third Class within the State of Kansas, having been incorporated on the 26th day of November, 1980 and its Governing Body having been elected on the 17th day of February, 1981, and the boundaries of the incorporated City of Bel Aire has encompassed and enclosed all of the territory of the Bel Aire Improvement District and is acting under the authority of an Act of the Legislature of the State of Kansas, 1981 Session, H.B. 2212 as amended by the Senate Committee. It became a duly incorporated City of the Second Class within the State of Kansas on July 4, 1998 by a Proclamation of Kansas Governor Bill Graves dated June 29, 1998.

2.4.10. Bel Aire improvement district assumption.
The City of Bel Aire shall take over all property and assets and assume all debts, liabilities and obligations and shall perform all functions and services of the Bel Aire Improvement District and the Bel Aire Improvement District shall be abolished.

2.4.11. Assumption date.
The date upon which the City of Bel Aire shall take over and the Bel Aire Improvement District shall be dissolved will be the 15th day of May, 1981.

2.4.12. Special assessment assumption.
The City of Bel Aire shall assume and pay as a general obligation of the City of Bel Aire, all special assessments which have been levied against specific lots, parcels or tracts of property within the Bel Aire Improvement District by the Bel Aire Improvement District except special assessments for streets, lateral sewers and water distribution systems. Real property within the District shall be discharged from the lien of any special assessments or taxes or special taxes levied to pay for the costs of the improvements, except special assessments or special taxes which were levied for the purpose of paying for street improvements, lateral sewers and/or water distribution systems. Any individual tax payer who owns property within the Bel Aire Improvement District shall have power to bring suit to force the City of Bel Aire to abide by and carry out the terms and provisions of this Section.
