Article 8. Police Department

2.8.1. Department created.
The police department of the City of Bel Aire shall consist of police officers hired in conformance with Charter Ordinance 14, one of whom shall be the Chief of Police and such other necessary members.

2.8.2. Chief duties.
The Chief of Police shall have general charge and control of the police department. In the discharge of his duties, the Chief of Police shall be subject to the orders of the City Manager and shall perform such other duties as are prescribed or authorized by law, this Code or ordinance and as may be assigned by the City Manager, including the development of departmental rules and regulations adopted in conformance with the City’s Personnel Policy. All other police officers shall perform the duties and exercise the powers as are prescribed or authorized by law, this Code or ordinance or as may be assigned to them by the Chief of Police and City Manager.

2.8.3. Police officer duties.
Police Officers while on duty shall devote their time and attention to their respective duties according to this Code and the ordinances of the City and the laws of Kansas. It shall be their general duty at all times to the best of their ability to preserve good order, peace and quiet and to enforce this Code and the ordinances of the City and the laws of Kansas throughout the City. It shall be their further duty to arrest when required by law all persons found at any time, day or night, in the act of violating this Code and any such ordinance or law, or aiding or abetting any such violation. They shall make complaint against any and every person arrested upon probable cause.

2.8.4. Power to arrest.
The Chief of Police and all police officers shall at all times have power to make or order an arrest with proper process in all cases where permitted under state statute, and keep such arrestee in jail or other safe place to prevent their escape, until bond is set and met, or a trial can be had before the municipal court or other court having jurisdiction of the offense alleged.

2.8.5. Hours and salary.
The Chief of Police and police officers may be full time or part time officers as deemed advisable by the City Manager. Salaries of the Chief of Police and police officers shall be fixed pursuant to the provisions of the City’s Salary and Wage Scale.
