Article 3. Failure To Appear

5.3.1. Failure to appear.​

Any person who fails to appear and answer to a written summons, notice to appear, complaint and notice to appear, or a subpoena issued to such person by a City Police Officer or by the Municipal Court for any violation of this Code or a City ordinance or for the purpose of securing such persons testimony before the Municipal Court, or a person who has been issued a traffic infractions notice who fails to either appear or pay the stated fine at the time designated thereon, shall be deemed guilty of a misdemeanor, and fined in accordance with the fine as set forth on the fine schedule established by the municipal court, and included with the City’s Schedule of Service, License and Permit Fees.

5.3.2. Failure to appear after release.​

Any person released from custody to appear at a later time before the Bel Aire Municipal Court who fails to make such appearance at the designated time, shall be deemed guilty of a misdemeanor, and fined in accordance with the fine as set forth on the fine schedule established by the municipal court, and included with the City’s Schedule of Service, License and Permit Fees.
